NOTICE OF SALE OF M/V “CARMEN SILVA” 1. Offers for the acquisition of the hereinafter detailed motor vessel “CARMEN SILVA” IMO 9044920 (hereinafter: “the Vessel”), “As Is Where Is”, clean of any debt or lien, are hereby invited, by the undersigned the Co-Receiver of the vessel (hereinafter: “the Receivers”), appointed by the Admiralty Court in Haifa. The vessel is presently arrested in Israel at the Port of Ashdod. Offers should be submitted in writing by and not later than Sunday, 12 January, 2014, at 12:00 hrs., to the law office of the undersigned Receivers. Each offer should be accompanied by a cash deposit or by an irrevocable confirmed bank guarantee issued by a first class Israeli bank made out to the order of the undersigned Receivers for 10% (ten percent) of the offer and which deposit amount shall not be less than USD 75,000 (Seventy-five Thousand United States Dollars).
The cash deposit or bank guarantee (“the Deposit”) shall be returned to unsuccessful offerors, and shall be forfeited in event that the successful offeror revokes his offer or should the successful offeror fail to satisfy any of the conditions of sale after his offer has been approved by the Court.
2. The offers will be submitted by the undersigned Receivers to the Court and on Monday, 13 January, 2014, at 14:00 hrs, a public competition will be conducted between the offerors at the District Court in Haifa, 12 Palyam Blvd., Haifa, Israel, before the Honourable Judge Mr. Ron Sokol.
3. The acceptance of any offer is in the sole discretion of the Court. The undersigned Receivers will not be obliged to accept or to recommend to the Court acceptance of any offer whatsoever.
4. Particulars of the vessel as hereunder (were provided by the vessel's command) and the undersigned Receivers shall neither be liable as to their correctness nor to their accuracy. In any case whatsoever, the offerors shall be responsible solely for inspection of the vessel and investigating all the details concerning the vessel or deriving from her:
